2. Definitions

In these Terms and Conditions:

  • “Platform” means the CampSuite web application, APIs, and related services operated by WorkBee Limited.
  • “User”, “you”, or “your” means any person or entity who registers for or uses the Platform, including campsite owners, operators, and their staff.
  • “Guest” means any person who makes a booking through the Platform’s public booking pages.
  • “Booking Fee” means the platform fee charged to Guests per online booking on the Express plan, in the currency the Site trades in: £1.50 (inclusive of VAT) for a Site trading in pounds, €1.75 for a Site trading in euro.
  • “Services” means the booking management, calendar, guest communication, payment processing, and related features provided through the Platform.
  • “we”, “us”, or “our” means WorkBee Limited.

3. Acceptance of Terms

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or through the Platform.

4. Account Registration

To use the Platform, you must:

  • Be at least 18 years of age.
  • Provide accurate, current, and complete registration information.
  • Maintain the security of your account credentials.
  • Accept responsibility for all activity under your account.
  • Promptly notify us of any unauthorised access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

5. Subscription Plans and Fees

5.1 Express Plan (Free)

The Express plan is provided free of charge to Users. A Booking Fee is charged to Guests for each online booking made through the Platform: £1.50 (inclusive of VAT) where the Site trades in pounds, and €1.75 where it trades in euro. The Booking Fee is a price set for each currency, not a conversion of the other. This fee is collected by WorkBee Limited at the time of booking.

5.2 Paid Plans

Paid subscription plans are billed monthly. Prices are as displayed on the Platform at the time of subscription. All paid plan prices are exclusive of VAT unless otherwise stated. No Booking Fee is charged to Guests on paid plans.

5.3 Free Trials

We may offer free trial periods for paid plans. At the end of a trial, you will be returned to the Express plan unless you subscribe to a paid plan. We will not charge you without your explicit consent.

5.4 Cancellation

You may cancel your paid subscription at any time. Access to paid features will continue until the end of your current billing period. Upon cancellation, your account will revert to the Express plan. No refunds are provided for partial billing periods.

6. Payment Processing

Payment processing is provided through Stripe. By using our payment features, you also agree to Stripe’s Terms of Service.

We do not store your full credit or debit card details on our servers. All payment information is handled securely by Stripe in compliance with PCI-DSS standards.

Users who connect their own Stripe account for receiving guest payments are responsible for their own Stripe account compliance and fees.

7. User Responsibilities

As a User of the Platform, you agree to:

  • Use the Platform only for lawful purposes and in accordance with these Terms.
  • Ensure that all information you provide (including campsite details, pricing, and availability) is accurate and up to date.
  • Comply with all applicable laws and regulations, including data protection legislation (UK GDPR and the Data Protection Act 2018).
  • Not use the Platform to transmit harmful, offensive, or illegal content.
  • Not attempt to interfere with, disrupt, or gain unauthorised access to the Platform or its systems.
  • Maintain appropriate insurance for your campsite operations.

8. Intellectual Property

All intellectual property rights in the Platform, including but not limited to software, design, logos, and content, are owned by WorkBee Limited or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Platform in accordance with these Terms.

You retain ownership of any content you upload to the Platform (such as campsite descriptions, images, and pricing). By uploading content, you grant us a licence to use, display, and distribute that content solely for the purpose of providing the Services.

9. Data Protection

We process personal data in accordance with our Privacy Policy, UK GDPR, and the Data Protection Act 2018.

Where you use the Platform to process personal data of your guests, you act as the data controller and we act as a data processor. You are responsible for ensuring you have a lawful basis for processing guest data and for providing appropriate privacy notices to your guests.

10. Limitation of Liability

To the fullest extent permitted by law:

  • The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied.
  • We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
  • Our total liability to you for any claims arising from or related to these Terms or the Platform shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or business opportunities.
  • We are not liable for any loss or damage arising from bookings, guest disputes, or campsite operations managed through the Platform.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless WorkBee Limited, its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform.
  • Your breach of these Terms.
  • Your violation of any applicable law or regulation.
  • Any dispute between you and your guests.
  • Any content you upload to the Platform.

12. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. We may suspend access to the Platform for maintenance, updates, or other operational reasons. We will endeavour to provide reasonable notice of planned downtime where possible.

13. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account immediately if you breach these Terms. Upon termination:

  • Your right to access the Platform will cease.
  • We may retain your data for a reasonable period in accordance with our Privacy Policy and legal obligations.
  • Any outstanding fees remain payable.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, internet failures, or third-party service outages.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WorkBee Limited regarding the use of the Platform.
